Terms of Service

1. Acceptance of Terms
By accessing or using BooQerz (the "Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform. BooQerz is an independent eBook marketplace that connects authors directly with readers.
2. Definitions
"Platform" refers to BooQerz and all associated services. "Author" refers to any user who uploads and sells eBooks on the Platform. "Buyer" or "Reader" refers to any user who purchases eBooks on the Platform. "Highlight" refers to the optional paid featured placement on the Platform's homepage.
3. User Accounts
To use certain features of the Platform, you must sign in using your Replit account. You are responsible for maintaining the security of your account and for all activities that occur under it.
4. Author Obligations
As an author on BooQerz, you represent and warrant that you own or have the necessary rights to the content you upload, your content does not infringe upon third-party intellectual property rights, your book descriptions are accurate, and you comply with all applicable laws. Authors must pay a one-time platform fee of €2.50 per book to publish.
5. Buyer Rights
When you purchase an eBook on BooQerz, you receive a personal, non-transferable, non-exclusive license to read and use the eBook for your own private purposes. You may not redistribute or resell purchased eBooks. Buyers retain access to purchased books through their library, even if the author later removes the book from sale.
6. Fees and Payments
BooQerz uses the following fee structure: Publishing Fee of €2.50 per book (one-time), 2% sales commission per sale (authors keep 98%), and an optional Highlight Fee of €5.00 for 7-day featured placement. All payments are processed securely through Stripe.
7. Intellectual Property
Authors retain full ownership of their content. By uploading content to BooQerz, authors grant the Platform a non-exclusive license to display and promote their content for the purpose of facilitating sales. The BooQerz name and logo are the intellectual property of BooQerz.
8. Prohibited Content
Prohibited content includes: content that infringes on intellectual property rights, defamatory or threatening content, malware or harmful code, content violating applicable law, and misleading content designed to deceive buyers.
9. Reviews and Ratings
Only verified buyers may leave reviews. Reviews must be honest, may not contain offensive language or spam, and are limited to 250 characters.
10. Limitation of Liability
BooQerz provides the Platform "as is" without warranties of any kind. BooQerz is not responsible for the content of eBooks sold on the Platform. Authors are solely responsible for the accuracy and legality of their content.
11. Governing Law
These Terms of Service are governed by the laws of the Federal Republic of Germany.
